Resident Visitation Policy

Policy Statement
It is the policy of the HIBISCUS PALACE group to ensure appropriate visitation is provided to our residents in a safe, respectful manner and in accordance with Florida Statute Section 408.823 (No Patient Left Alone Act) and Florida Statute 429.28(1)(d).

At Hibiscus Palace, the health, well-being, dignity, and rights of our residents are top priorities. Every action and measure we put in place reflects our commitment to residents, their families, and our community.

The State of Florida has issued guidance regarding visitation expectations for assisted living facilities. Hibiscus Palace promotes and supports visitation while maintaining reasonable procedures to protect resident privacy, safety, and facility operations.


1. General Visitation Standards

  1. In-person visitation is permitted in all circumstances unless the resident objects, or the resident’s Guardian/Responsible Party directs otherwise, consistent with applicable law.
  2. Visitation may occur in multiple settings, including:
    • Resident rooms
    • Designated visitation areas
    • Common areas (as appropriate)
    • Outdoor spaces (when available)
  3. General visiting hours:9:00 a.m. to 9:00 p.m.
    • Special consideration will be given to the community’s routine, including other residents’ rest times.
    • Essential caregivers may have open visitation as allowed by law and facility procedures.
  4. Number of visitors: No set limit; however, visits must remain reasonable based on space, resident comfort, and the ability to maintain a calm environment for all residents.
  5. Resident support designee: The resident or their legal representative (e.g., POA/Guardian) may designate a person who may remain with the resident around the clock during emergencies, extenuating circumstances, or life-threatening situations, consistent with resident rights and facility safety needs.
  6. Resident consent and dignity:
    • Visitors must respect the resident’s preferences and boundaries.
    • Consensual contact is acceptable; if unsure, ask the resident first.
  7. Visitation is especially supported in the following circumstances (and will not be unreasonably restricted):
    • When a resident is struggling with transition or emotional adjustment after admission
    • End-of-life situations
    • When a resident is experiencing emotional distress or grieving a recent loss
    • When a resident benefits from family encouragement with meals or hydration
    • When a resident is making major medical decisions

2. Visitor Expectations (Safety, Courtesy, and Respect)

To maintain a safe and supportive environment for all residents, visitors are expected to:

  • Sign in/out when requested and comply with reasonable identification procedures.
  • Respect privacy and confidentiality, including other residents’ rooms and personal information.
  • Maintain a calm environment, including keeping noise to a respectful level, especially in hallways and common areas.
  • Supervise children at all times.
  • Follow facility rules regarding prohibited items and behaviors (including smoking/vaping policies, weapons, alcohol/illegal substances, harassment, or disruptive conduct).
  • Use good personal hygiene practices and follow any posted facility instructions while on-site.
  • Follow staff direction when needed to protect resident safety, preserve privacy, or address an operational concern.

Note: If a visit creates a safety concern, significantly disrupts resident care, or infringes on another resident’s rights, staff may redirect the visit to an alternate location, request a pause, or establish reasonable conditions to continue the visit safely.


3. State Representative Visitation

The facility will not deny access to any state representative. Such visitors are expected to follow the facility’s general visitation guidelines, including reasonable sign-in and safety procedures.


4. Temporary Restriction or Suspension of Visitation

Visitation is a protected right and will not be restricted without good cause. However, the facility may temporarily limit or suspend visitation when necessary to protect resident safety or manage facility operations during:

  1. An acute emergency at the facility (e.g., fire, evacuation, loss of power, loss of essential services, law enforcement activity, or unsafe building condition).
  2. A temporary staffing shortage that meaningfully affects the facility’s ability to maintain safe operations and has been handled according to required reporting/notifications (if applicable).
  3. A safety or security threat (e.g., credible threats, violent or disruptive conduct, or other conditions requiring controlled access).

Any temporary limitation will be no broader than necessary, will be reviewed regularly, and will be adjusted or lifted as soon as conditions permit.


5. Responsibility

The Administrator (or designee) is responsible for implementing this policy and ensuring staff adherence.
